Nepal legally allows a foreign national to marry a Nepali citizen or another foreign national through a court marriage, provided both parties meet the legal requirements under the National Civil Code, 2074 (2017). The marriage is registered before the competent District Court.
Eligibility Requirements
Before applying, both parties must:
Be 20 years of age or older.
Enter into the marriage with free and full consent.
Be legally unmarried, or provide proof that any previous marriage has been legally dissolved.
Not be within a prohibited degree of relationship under Nepali law.
A foreign applicant is generally required to submit:
A valid passport.
A valid Nepal visa.
A No Objection Certificate (NOC) or Certificate of No Impediment/Single Status Certificate issued by the applicant's embassy or the competent authority of their home country.
Proof of at least 15 consecutive days' residence in Nepal, usually supported by a temporary residence certificate.
A notarized Nepali translation of the marriage law of the applicant's home country, where required.
Passport-size photographs.
Divorce decree or death certificate of a former spouse, if previously married.
Identification documents of two witnesses.
Step 1: Stay in Nepal
The foreign national must ordinarily reside in Nepal for at least 15 consecutive days before filing the marriage application.
Step 2: Obtain a No Objection Certificate (NOC)
Visit your country's embassy or consulate in Nepal to obtain a No Objection Certificate, confirming that there is no legal obstacle to your marriage under the laws of your home country.
Step 3: Prepare the Required Documents
Collect and organize all required documents, including passport, visa, NOC, photographs, translations, and any additional supporting documents. Ensure that foreign-language documents are translated and notarized where necessary.
Step 4: File the Application at the District Court
Submit a joint application with all supporting documents to the competent District Court. The court will verify the documents and confirm that all legal requirements have been met.
Step 5: Court Appearance
Both parties and the required witnesses must appear before the court. The judge will verify the identity of the parties, ensure that the marriage is based on free consent, and confirm compliance with Nepali law.
Step 6: Issuance of the Marriage Certificate
Once the court approves the application, it issues an official Marriage Certificate, which serves as legal proof of the marriage in Nepal. Depending on the country where it will be used, additional attestation or legalization may be required for international recognition.
